These Terms of Service ("Terms") govern your use of the Vinyl Restore application ("the App") published by Bulpara Inc ("we", "us", "our"). By downloading or using the App, you agree to these Terms.

1. Service Description

Vinyl Restore is an iOS application that records analog audio — vinyl records, 45s, 78 RPM shellac, cassettes, and reel-to-reel tape — into your iPhone and removes clicks, crackle, pops, and surface hiss. Cleaning runs on your device using bundled DSP and a Core ML model. Features include in-app recording (from a USB turntable, audio interface, or the built-in mic), audio file import, a software RIAA equalization option, per-stage de-click / de-crackle / de-hiss strength controls, an A/B before/after compare slider, automatic track-splitting, and export to your library.

2. Important Limitations

Vinyl Restore is an audio cleanup tool, not a guaranteed restoration service. You understand and agree that:

• The App is tuned for analog surface noise — clicks, pops, crackle, and hiss. Results depend on the condition of the record or tape and the quality of your capture chain.
• Severely damaged, deeply scratched, or heavily worn media may leave audible residual artifacts. Light-to-moderate surface noise is the App's primary use case.
• Output quality depends on the original recording's noise floor, your turntable or interface, the cartridge, and the signal-to-noise ratio of the capture.
• Transient-aware cleaning is designed to preserve musical detail, but no on-device tool can fully reconstruct content lost to damage.
• The App is not a replacement for professional audio restoration or studio post-production.

3. Acceptable Use

You agree to use the App only for lawful purposes and only on audio you have the right to record and process. You agree not to:

• Infringe the copyright of any sound recording or composition you do not own or have permission to digitize
• Distribute restored recordings in violation of applicable copyright law or third-party rights
• Reverse engineer, decompile, or extract the bundled or downloadable machine-learning models
• Attempt to circumvent subscription restrictions or free-tier limitations
• Use the App in any manner that violates applicable laws or third-party rights

4. Subscriptions & Billing

• Free tier: No charge. Record and clean clips up to 90 seconds, 1 export per day, with banner and interstitial advertising.
• Premium Monthly: $8.99/month. Unlimited exports, full-length sides, the downloadable Studio model, lossless WAV and FLAC export, automatic track-split export, batch processing, and zero ads.
• Premium Annual: $39.99/year (save 63% vs. monthly), with a 7-day free trial. Same Premium feature set as monthly.
• Subscriptions are billed through the Apple App Store and are subject to Apple's Terms of Service.
• Payment is charged to your Apple ID at confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
• You can manage and cancel your subscription through your Apple ID settings. Cancellation takes effect at the end of the current billing period.
• If you cancel during a free trial period before the trial ends, you will not be charged.
• We reserve the right to change pricing with 30 days' notice. Existing subscribers retain their original price for the remainder of the active term.

5. User Content

Recordings, restored files, and library data are stored locally on your device. You retain all rights to your audio. We do not access, collect, or store your content on any server.

6. Intellectual Property

The App, including its design, code, and packaged content, is owned by Bulpara Inc and is protected by copyright and other intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the App for its intended purpose. The bundled and downloadable machine-learning models are licensed for use within the App only and may not be extracted or redistributed.

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE OR UNINTERRUPTED, OR THAT RESTORATION RESULTS WILL MEET YOUR EXPECTATIONS FOR A SPECIFIC RECORDING.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BULPARA INC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO:

• Decisions made based on a restored recording (publication, distribution, sale)
• Audio quality of restored outputs, including residual artifacts from damaged media
• Loss of original recordings due to user error or device failure
• Subscription-related charges that fall under Apple's billing policy

9. Indemnification

You agree to indemnify and hold harmless Bulpara Inc from any claims, damages, or expenses arising from your use of the App, including any audio you record, process, and distribute.

10. Termination

We may terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or the business.

11. Changes to Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated revision date. Continued use of the App after changes constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of laws provisions.
